Aanvaarding van het reglement
Door aankoop van een toegangsticket gaat de bezoeker akkoord met dit huisreglement.
Minimum leeftijd
Toegang is verboden onder de 18 jaar. De organisatie, toegewezen security-leden of andere organisatieleden behouden het recht om de identiteitskaart van de bezoeker te controleren tijdens het evenement.
Tickets
De bezoeker kan kiezen of hij een uitgeprinte versie of een mobiele versie van het ticket meeneemt naar het evenement. Ondanks het feit dat er zich nog nooit problemen hebben voorgedaan, is de organisatie niet verantwoordelijk voor het niet kunnen scannen van het toegangsticket wanneer de oorzaak hiervan niet in haar handen ligt.
Veiligheid
Om de veiligheid op het evenement te maximaliseren, is de organisatie bevoegd om security checks te organiseren aan de ingang of doorheen de evenementenlocatie. De organisatie streeft naar een zo veilig en aangenaam mogelijke ervaring voor iedereen, maar het bijwonen van het evenement gebeurt op risico van de bezoeker. De organisatie zal nooit aansprakelijk zijn voor enige schade, inclusief:
- voorwerpschade
- diefstal
- fysieke, esthetische of psychische schade.
Verboden voorwerpen
De organisatie, toegewezen security-leden of andere organisatieleden behouden het recht om de bezoeker de toegang tot het evenement te weigeren wanneer de bezoeker in het bezit is van volgende objecten aan de ingangscontrole, op de parking, of andere zones die zijn gelinkt aan het evenement:
- softdrugs en harddrugs van alle soorten, of elke substantie dat potentieel fysieke of mentale schade kan toebrengen aan individuen;
- wapens of andere objecten dat schade kunnen toebrengen aan inidividuen of objecten;
- objecten, accessoires of kledij die potentieel kunnen aanzetten tot haat of discriminatie;
- eigen voedsel of drinkwaren;
- glazen flessen of andere fragiele materialen;
- vuurwerk;
- professionele apparatuur voor fotografie, videografie of andere opnamevormen.
De bezoeker erkent dat de organisatie de volledige beoordelingsvrijheid én het laatste woord heeft. De organisatie heeft bovendien de mogelijkheid om politie in te schakelen na ontdekking en onderschepping van drugs of wapens. In geval van toegangsweigering, heeft de bezoeker geen recht op terugbetaling.
Gedragsregels
De organisatie, toegewezen security-leden of andere organisatieleden behouden het recht om bezoekers onmiddellijk van het evenement te verwijderen in de volgende gevallen:
- vechten of ander fysieke agressie;
- beledigen of andere types van verbale agressie;
- discriminatie op basis van ras, religie, geslacht, geaardheid, fysieke of geestelijke capaciteit, of uiterlijke kenmerken;
- lastigvallen, (seksuele) intimidatie of andere acties die serieus ongemak bij andere bezoekers teweegbrengt;
- vandalisme of andere acties die potentieel of effectief schade toebrengen aan objecten of de natuur;
- diefstal of andere acties die strafrechtelijk vervolgbaar zijn;
- roken buiten de voorziene rookruimtes;
- alcoholmisbruik;
- druggebruik;
- drugs dealen;
- de backstage of andere zones betreden die uitsluitend toegankelijk zijn voor de organisatie, toegewezen security-leden of andere organisatieleden;
- niet gehoorzamen of ingaan tegen instructies van de organisatie, toegewezen security-leden of andere organisatieleden.
De bezoeker erkent dat de organisatie de volledige beoordelingsvrijheid én het laatste woord heeft. De organisatie heeft bovendien de mogelijkheid om politie in te schakelen. In geval van toegangsontzegging, heeft de bezoeker geen recht op terugbetaling.
Goedkeuring om gefotografeerd te worden
De bezoeker geeft zijn of haar akkoord om te mogen worden gefotografeerd of gefilmd. De organisatie heeft het recht om het visueel materiaal te gebruiken voor alle doeleinden en openbaar te maken.
Volledige beoordelingsvrijheid van de organisatie inzake niet vermelde aangelegenheden In toevoeging aan de expliciet voorgenoemde elementen in dit reglement, moeten bezoekers en ticketaankopers zich gedragen als een normaal, redelijk en vooruitziend persoon in dezelfde omstandigheden. In het onfortuinlijke geval dat er alsnog een dispuut ontstaat tussen de organisatie en de bezoeker of ticketaankoper inzake onderwerpen die niet bij dit reglement expliciet geregeld worden, heeft de organisatie het laatste woord. De organisatie behoudt bovenmeer ten allen tijde het recht om gepaste maatregelen te nemen, inclusief juridische actie alsmede het contacteren van de politie.
Terugbetalingsbeleid
Conform Belgisch recht worden tickets voor evenementen niet terugbetaald, zelfs wanneer er zich veranderingen voordoen in de programmatie of line-up. De ticketaankoper zal alleen het recht op terugbetaling hebben wanneer het evenement wordt geannuleerd, behoudens overmacht of vreemde oorzaak.
Toepasselijk recht en bevoegde rechtbank
In het onfortuinlijke geval dat er een dispuut ontstaat tussen de organisatie en de bezoeker of ticket aankoper, is het Belgisch recht toepasselijk en hebben de Belgische rechtbanken jurisdictie.
Acceptance of our rules
By purchasing an entry ticket or attending our event, you agree to our house rules.
Minimum age
Entry is restricted below the age of 18 years. The organisation, designated security staff or other organisation officials preserve the right to control the visitor’s ID card at any time during the event.
Tickets
The visitor is free to use a printed out version or or a mobile version of the entry ticket. Notwithstanding the fact that there have never been any issues in the past, the organisation is not accountable for any ticket scan failures that fall outside the organisation’s own will or responsibility.
Security and safety
In order to maximize safety on the events, the organisation preserves the right to organize security checks at the entrance or throughout the event area. The organisation strives to guarantee a safe and pleasant experience for everyone, yet attendance of our events happens at the visitor’s own risk. The organisation will never be liable for the damage to goods, theft, physical or mental harm.
Allowed objects
The visitor is allowed to enter the event along with the following items (indicative and non-exhaustive):
- Mobile phones, smartphones and tablets;
- Backpacks;
- Small, non-professional cameras;
- Sunglasses;
- Cigarettes and tobacco;
- Hats and beanies;
- Medicine;
- Non-drinkable liquids and gels (e.g. hand sanitizer) in amounts up to 100ml, with a total of max. 1l.
Notwithstanding the aforementioned, the organisation, designated security staff or other organisation officials preserve the right to deny any item that could potentially jeopardize the general safety of the event or that could constitute a manifestly unreasonable abuse of these rules. The visitor acknowledges that the organisation has full discretion in these matters.
Forbidden objects
The organisation, designated security staff or other organisation officials preserve the right to refuse entry when the visitor is in possession of the following objects at the event, campsite, parking area or other areas related to the venue or festival site:
- soft drugs and hard drugs of any kind, or any substance that could potentially consitute mental or physical damage to individuals;
- weapons or other objects that may induce harm to individuals or objects;
- objects or garments that could potentially invoke hate or discrimination towards individuals;
- own food or drinks;
- (glass) bottles or other fragile products;
- fireworks;
- professional photography, filming or recording material;
- drones;
- laser pens;
- gas and gas burners;
- animals (except guiding dogs for the impaired);
- any other object that could be considered dangerous by the organisation, designated security staff or other organisation officials.
The visitor acknowledges that the organisation has full discretion in these matters. Moreover, the organisation is entitled to contact the police in case of drug or weapon possession. In case of refusal of entry, the visitor will not have any right on restitution or refund.
Rules of conduct
The organisation, designated security staff or other organisation officials preserve the right to immediately remove visitors from the event in case of the following events:
- fighting or other means of physical damage;
- insulting or other types of verbal agression;
- discrimination on grounds of race, religion, gender, sexual orientation, physical or mental capacity or appearance;
- harrassment, sexual intimidation or other actions that may induce serious discomfort to individuals;
- vandalism or other acts that potentially or effectively impose damage to objects or nature;
- theft or other related actions prohibited under criminal law;smoking outside of the designated smoking areas;alcohol abuse;
- drug consumption;drug dealing;
- sneaking backstage or trespassing other areas that are solely accessible for the artists, organisation, designated security staff or other organisation officials;
- disobeying or not complying with clear instructions from the organisation, designated security staff or other organisation officials.
The visitor acknowledges that the organisation has full discretion in these matters. Moreover, the organisation is entitled to contact the police in the above mentioned events. In case of removal, the visitor will not have any right on restitution or refund.
Permission to be photographed
The visitor agrees to be photographed and filmed on all events. The organisation has the right to use all footage for whatever use they seem fit.
Full discretion of the organisation concerning non-included matters
In addition to the explicit elements mentioned in these house rules, visitors and ticket buyers must comply with the reasonable conduct standards that are expected from a regular ticket buyer or visitor. In the unfortunate event of a dispute concerning the written or unwritten rules, the organisation has full discretion and will always have the final say. The organisation will always preserve the right to take appropriate measures, including legal proceedings or law enforcement notification.
Legal liability
Secret Garden is only liable for any shortcoming attributable to it, regardless of whether it is of a contractual or non-contractual nature, insofar as this liability is not explicitly excluded or limited in these General Terms and Conditions. Our total liability is in any case limited to compensation for direct damage and can never be higher than the value of the service provided, being the admission ticket. Liability for any form of indirect damage is expressly excluded. Liability in the event of force majeure is completely excluded.
Force majeure
Force majeure is understood as any circumstance beyond the control of Secret Garden, which even temporarily prevents it from fully or partially fulfilling its obligations. Secret Garden is not liable for the commitments of its partners.
Legal proceedings
Every third party (including visitors) who, due to an error attributable to him, jeopardizes the liability of Secret Garden, including its employees, must indemnify Secret Garden in full and on first request against any third-party claim. This safeguard obligation means that you must always voluntarily intervene in any dispute and / or legal proceedings brought against Secret Garden by a third party and bear the possible financial consequences thereof.
Refund policy
In compliance with Belgian law, tickets for the events are not refundable after purchase, even if there are changes in the programming or the line-up. The ticket buyer will only have a right on refund when the organisation cancels the event and there is no presence of force majeure. In that particular case, the ticket price (excluding the service and administration costs) will be refunded to the person or company who placed the order.
Applicable law and competent court.
In the unfortunate case that a dispute arises and is related with these rules, Belgian law will be applicable. The Hasselt courts will have jurisdiction.
